Limited Use License Agreement
Users agree under terms of this agreement that IBI Global, Inc. is granting a "limited use license" to the viewer for benefit of the user. Permitted uses are private viewing, and public school use. Viewers agree in accepting this license that copy or reproduction of any of the lesson plans or material content on the IBI SUCCESS CHANNEL website, including the website pages, is expressly prohibited by international and United States copyright laws. No copy reproduction or use of the content of this channel may be made without first obtaining prior written permission from IBI Global, Inc.. Users may not charge any fee for the use or distribution of this channel. IBI Global retains full rights and ownership of all property rights, without limitation, and prior authority is required for any use outside "study" from the live broadcast presented on this site. Broadcasters expressly agree they may not reproduce or in any way reticence material presented on this website without the prior syndicate license for fee from IBI Global.
This channel is for informational and entertainment purposes only. The materials being broadcast include historical material from previously presented CEO Retreat Weeks and each lesson plan is presented as part of an out of context multi day integrated lesson plan. The materials are reproduced from lessons provided over a period of 15 years and over thousands of lesson plans. In some cases, the information being broadcast is no longer applicable due to changes in laws, the market, industry and technology. All content is presented for the viewer study and enjoyment and future action in area requiring legal compliance MUST include outside user retained legal counsel Users agree that they hold IBI Global harmless from any claim of damage in any form as a result of viewing this Channel. Users expressly understand that faculty presentations are created by independent contractors with IBI Global, such that all broadcast and unconditional rights to image and materials have been expressly released to IBI by prior enrollment contract, faculty manuals and oral release agreements. IBI Global is not responsible for advice, coaching, or information presented by independent faculty online or in person at IBI Global CEO Retreat Weeks. Each faculty is solely responsible for their individual content and IBI Global is not responsible for any action viewers may take related to such advice. Viewers note that content on this website is for entertainment and general non specific education purposes only Further it is understood any content that is not legal or lawful in any jurisdiction of law worldwide is deemed null and void and not applicable in such jurisdiction and each viewer notes that content on this broadcast channel will not be relied upon for any area of legal compliance. Viewers agree and IBI relies upon the warranty by all viewers that viewers are solely and individually responsible for all legal compliance now and in the future and IBI Global is indemnified from any liabilities related thereto now and forever. Viewers agree that in the event of breach of this agreement in part or entirety or any claim of damage of any nature or kind against IBI Global, that IBI Global will be entitled to stipulated damage fee's to include quarterly prepayment of all litigation expense and related costs including private investigation as will be estimated from time to time to any court of law and that a stipulated damage fee of $500.00 will be prepaid for each day such claim or breach remains unheeded to IBI Global's full and complete satisfaction as shall be expressed in writing. This limited license will remain in force for a period of three years from the date of last viewing of this website by date. It is agreed the jurisdiction for any disputes arising out of or related to this limited license will be the State of Alabama without substitution and that no modification of this agreement may be made without written consent of the parties. Recording any part of the IBI Success Channel website broadcast or content is expressly prohibited. This site is restricted where prohibited by law. This agreement is deemed perfected severally each time the viewer clicks to access the IBI Success Channel website whereby such access constitutes a legal signature authority with viewer warranty they have read this full and complete license agreement and expressly agree to all terms and conditions when engaging in use of any kind to this website. No claim by the user that they did not read the license may be made now or at a later date following first use by the viewer, as all use is deemed to perfect the agreement without recourse of any kind. Should any part of this limited license be deemed unenforceable in a court, all remaining clauses will remain in force and binding as the entire agreement. The forgoing represents the entire agreement between the viewer and IBI Global Inc. upon which "free and open" access to the IBI Success Channel Is Granted. |
